Illegal filling of posts of EST(PET) through promotion contrary to service rules

SUBJECT: IRREGULAR / ILLEGAL FILLING OF POSTS OF ELEMENTARY SCHOOL TEACHER (PHYSICAL EDUCATION) THROUGH PROMOTION CONTRARY TO SERVICE RULES.

In continuation of this department’s letter of even number dated 21.10.2019 wherein it was directed to withdraw all such orders regarding promotion as Elementary School Teacher (Physical Education) contrary to the Punjab School Education Department (School Education) Service Rules, 1987, amended from time to time and to make recoveries as per law.
2. Hon’ble Supreme Court of Pakistan vide judgment dated 18.10.2019 in Civil Petition No 4439/2017 and CMA No 8554/2017 titled as Shams ur Rehman etc Vs. Military Accountant General, Rawalpindi etc set aside order dated 17.10.2017 by learned FST in which recoveries were made applicable on appellants (copy enclosed).
3 Thus, keeping in view the above said judgment the Competent Authority has desired not to make recoveries upon the incumbents whose promotion order as ESTs (Physical Education) were withdrawn.
